WHAT DOES IT MEAN?

I was lucky enough to move to Spain pre-Brexit, back in the good old days when things were more simple.  Yes I am that old! Back when moving from EU country to EU country was pretty much the same as moving to the next county. Times have changed and my own children are now replacing their British passports with Spanish passports to allow them the same freedoms.

Since Brexit, moving to an eu country has become a little more complicated and third country nationals (UK included) have had to apply for visas to live and work in Spain.

Moving with the times, Spain have realized that covid has brought about a whole new way of working and digital nomad are the new buzz words.

Spain has just announced that it plans to introduce a special digital nomad visa tax system for startups via a new law to come into effect this year, 2022. The proposed legislation aims to open Spain up to new talent and under the new law, these digital nomads would find it much easier to live and work in Spain.

Here are the key ideas behind the visa.

Facilitating paperwork for startups.

Reducing the tax burden on companies and entrepreneurs.

Streamlining the process to set up a business.

This visa is designed for non-resident individuals who wish to work remotely from Spain. It will facilitate the visa and residence permit applications and allow a stay of up to 5 years. And refreshingly there are tax benefits!

Holders would be eligible for a reduced rate of non-resident income tax. Instead of paying the usual rate of 25%, Spanish digital nomad visa holders would pay just 15% for up to four years AND the visa will include family members.

There are a few conditions attached:

Foreigners from third-party countries (including the UK) may apply for this type of visa if they work for companies based outside Spain. Their work for Spanish companies may not exceed 20% of the total.

They must prove the following:

That they have worked remotely for at least a year.

That the work can be carried out remotely.

If they are under contract to a company, that they have had a professional relationship with the company for at least three months and that the company permits remote working.

If they are freelance, that they work with at least one company outside Spain and provide the terms and conditions of the remote work.

There are no long commutes to a stuffy office. Your break can be taken walking next to the Med or at a local tapas bar. You could be sitting on a shady, cool terrace and jumping in your pool to cool down in-between zoom calls. Stress levels are lower and we wouldn’t want to be anywhere else.
